I was required to use my credit card to recived their coaching and sign a form that i could not get a refond. but now after 3 mounths i know this is clearly a scam. but because of the sign form i feel helpless. what cam i do?

You typically have 60 days to dispute a credit card charge. Even though you are past that point, I would go ahead and file a dispute with the credit card company. As far as getting it back from the company, if it is really a scam the odds are the you won’t be able to even deal with them.

I am sorry for the loss, but in the future dispute any charge within 60 days if you even suspect there’s a problem.

Do I, the buyer, have to pay out of pocket for the realtors commission or is it included in the selling price? Can I place a bid on a home for sale buy a realtor without using a realtor? Any other information along these line would be useful too.

You don’t have to pay a Buyer Agent. We gat paid from the seller’s Agent. Yes, you can put a bid in without an agent but then the seller’s Agent gets the whole comm. Is it legal to advertise other realtors listings?

I have other realtors in my office I can advertise for them, but being a realtor and the listings are the other realtor’s listings, I am not sure I can advertise the listings legally.

I’m not sure about the legality question, but it is against the Realtor Code of Ethics to advertise another agent’s listing without their permission.

Most agents I know will gladly give you permission to advertise it in place where they aren’t already advertising it. It’s just more exposure.

Coos Bay, Oregon.

House Bill 5036 authorizes the state to issue lottery bonds to fund the Coos Bay channel project to widen and deepen the lower bay shipping channel for a proposed container terminal on the North Spit.

With the legislation, lawmakers committed to funding $60 million for the project in an effort to woo APM Terminals, the U.S. operating division of AP Moeller Maersk, to build at Coos Bay.

As several friends of mine learned to their dismay, these "no money down" real estate courses are a scam. The only ones who make money are the ones running the courses.

A local realestate agency does not list any MLS listing on her site the PRMOTES ALL MLS listings that are listed by dicount brokerages. She is by far the biggest agency in my area, accounting for nearly half of all home sale listings. Some refer to it as a monopoly.

Since she promotes that her search engine on her site pulls up all MLS listings, could some one not seek a liability case? I know it is against the law for realtors to intentionally bypass FSBO listings, or dicounted brokerage listings. What is amazing is 95% of these sellers she bypasses in her system ARE OFFERING 3% to a selling agent. The other few are offering 2.5%.

I’m one of those excluded, despite being in the MLS and offering a commission. I had my brother call her agency about my home, they told him "it is not something you would be interested in, trust me!" They have never even seen it! Do I have a case?

This is an interesting question.

If she is advertising that she is allowing searches of all MLS properties and is screening out discount brokers and or lower commission offerings I would think that you could file a complaint against her with the MLS, local board of Realtors (if she is a Realtor), the state regulatory agency for agents/brokers for false advertising. You could contact the federal anti-trust attorney(s) they are always happy to look into real estate brokerages. By the way if they can turn up a antitrust case you get treble damages (if you can show that you were damaged).

In Texas I need to know when I can evict for late payment.?

Its a one year lease. Rent is due on the 1st, late charges begin on the 5th. The second month into the lease she pays on the 6th and is completely unconcerned about timely payment. Her emails sound unhinged. I got her through Gary Green realty who charged a fee for the vetting process- i didn’t just get her off the street! Can I start eviction proceedings on the 6th or do I have to wait 30 days after the due date. My anticipation is that here shortly she won’t pay at all and I want to be ready. Thank you for taking the time to read.

You cannot start the eviction process on the 6th.

First, you have to serve this person with a notice…a 3-day notice to cure or quit. This gives them the option to leave without penalty within the 3 day time period…or not.

If they do not leave, then you can pass that person onto your attorneys and begin the eviction process. Please keep all documentation in writting from this point on so that you can back yourself up in court.

Also, if you have sent lease violation notices as well, keep all of those documents.

Another option is to just hangout and wait through the lease (if you feel that you can) and then serve her with a 60-day notice to vacate. That way she has to be out in 60 days.

Please keep in mind that I am located in California and laws in real estate/property management vary from state to state. I suggest speaking with an attorney because these laws can be tricky and you dont want to end up oweing her anything.

Where can I find motivated sellers, not sellers who are just testing the waters to see what they can get for their home. I want to find a Good Deal! Maybe a homeowner who is in process of foreclosure and need to sell at a discounted price below market value. I am buying the property for investment purposes. Any realestate broker or agent who is willing to find me a DEAL?

There are always foreclosures listed in the paper. Try starting there.
